Injury Claim Process

Claim Process Our over-riding priority is to make the claim process as easy as possible for you, the claimant.

Initial Steps

  1. First you need to give us details of the circumstances of the accident and injury as well as the sequence of events. You can do this online or in writing by post.
  2. Then we’ll assess these details and decide whether we think you have a reasonable chance of successfully claiming compensation.
  3. Next we’ll put you in touch with one of the experienced, specialist personal injury solicitors we’ve used very successfully in the past. In the vast majority of cases the solicitor will be local to you. You will have a free face to face meeting with your solicitor, who will ask you questions and record all the information he judges to be relevant.

Making the Claim

  1. The solicitor sends a Letter of Claim to the defendant. This identifies your injuries, asserts their responsibility and states your intention to claim compensation.
  2. The solicitor will appoint a medical expert to give a professional assessment of the injuries you have suffered,
  3. The solicitor then follows up the Letter of Claim by sending the defendant a Schedule of Losses, which identifies the financial losses which are the subject of your claim. This acts as a request for payment One of two things will happen now.
  4. Either: The defendant will accept responsibility and the level of compensation will then be negotiated by your solicitor. This is the outcome in the vast majority of cases.
  5. Or: The defendant will dispute the claim, in which case, in the absence of any kind of agreement, the claim will go to court. This is a very rare outcome.

If you then win the case you will be awarded compensation and your solicitor’s costs. If you lose the case you will receive no compensation but you will not have to pay your solicitor’s costs.
